Overview. Welcome to Marco Belfiore. This store is operated by XM GROUP LLC, trading as Marco Belfiore (“we”, “us”, “our”), and is powered by Shopify. These Terms of Service, together with our Privacy Policy, Shipping Policy, Returns & Refund Policy and Legal Notice, govern your use of this website and your purchases. By using the site or placing an order you agree to them. If you do not agree, please do not use the site.

1. Eligibility and account

You must be of legal age in your country of residence to place an order. You are responsible for the accuracy of the information you provide and for keeping any account credentials secure.

2. Products

We describe our products as accurately as we can. Colours and finishes may vary slightly from what you see on screen. Descriptions and availability may change without notice, and we may limit quantities per order.

3. Orders

Placing an order is an offer to buy. We accept it when we send your dispatch confirmation. We may decline or cancel an order — for example where we suspect fraud, cannot verify payment, or an item is unavailable — and will refund any amount paid. Because orders are dispatched quickly, we cannot guarantee changes or cancellations after an order is placed; our 30-day return policy applies instead.

4. Prices, currency and payment

Our base currency is British pounds (GBP). Where local currency is supported, prices are displayed and charged in your local currency and the amount shown at checkout is the amount you pay; otherwise you are charged in GBP and your bank converts at its own rate. Prices may change at any time, but the price shown at the time you order is the price you pay. Shipping costs and any duties or taxes collected by us are shown at checkout before you confirm. You confirm that you are authorised to use the payment method provided.

5. Shipping and delivery

Delivery times are estimates and are set out in our Shipping Policy. Risk in the goods passes to you on delivery. We are not responsible for delays caused by carriers, customs or events outside our control, but we will always help resolve a lost or delayed parcel.

6. Returns, refunds and warranty

Returns, refunds and our 2-year warranty are governed by our Returns & Refund Policy, which forms part of these Terms.

7. Intellectual property

All content on this site is owned by or licensed to XM GROUP LLC and may be used only for personal, non-commercial shopping. “Marco Belfiore” and our product names and logos are our trademarks.

8. Relationship with Shopify

This store is powered by Shopify, which enables us to provide our services to you. Any sale you make is with XM GROUP LLC, not with Shopify. By using this site you acknowledge that Shopify is not responsible for any aspect of your purchase, and you release Shopify and its affiliates from claims arising from your transactions with us.

9. Privacy

Your personal information is handled in accordance with our Privacy Policy. Shopify also collects and processes certain information to provide the service; see the Shopify Consumer Privacy Policy.

10. Reviews and feedback

If you submit a review, photo or other content, you grant us a worldwide, royalty-free licence to use it in connection with our store and marketing. You confirm it is your own, truthful, and does not infringe anyone's rights. We may edit or remove content at our discretion.

11. Prohibited use

You may not use this site for any unlawful purpose, to infringe our or others' rights, to introduce malicious code, to scrape or copy our content, or to interfere with the site's operation.

12. Disclaimer and limitation of liability

To the fullest extent permitted by law, the site is provided “as is”, and our total liability for any claim arising from your use of the site or a purchase is limited to the amount you paid for the order concerned. We are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law or affects your statutory rights as a consumer, including under UK and EU consumer law.

13. Indemnity

You agree to indemnify XM GROUP LLC and Shopify against claims arising from your breach of these Terms or your unlawful use of the site.

14. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business. These Terms and our policies are the entire agreement between you and us.

15. Governing law

These Terms are governed by the laws of the State of Florida, United States. Disputes are subject to the courts of Orange County, Florida, without prejudice to any mandatory consumer rights in your country of residence, including the right of UK and EU consumers to bring proceedings in their local courts.

We may update these Terms by posting a new version on this page. Continued use of the site after a change means you accept the updated Terms.
